The Attorney General (AG) has given an undertaking to the Court of Appeal that former AG Dappula de Livera will not be arrested over his controversial statement related to the 2019 Easter Sunday attacks.

The undertaking was given when the petition filed by former AG Dappula de Livera on the summons issued by the Terrorism Investigation Division (TID) to record a statement on the comment made related to the Easter Sunday attacks was taken up for hearing today.

Filing the petition, the former AG stated that the Police are not vested with powers to question his activities during his tenure as the Attorney General and that it is a violation of the privileges given to an AG.

The former AG had, therefore, requested the court to issue an interim order preventing the summoning and his arrest over the matter.

The TID issued summons to the former AG on 19th and 21st April 2023 to record a statement he had made with regard to the 2019 Easter Sunday attacks, days before his retirement.

On the directives of Justice Minister Wijeyadasa Rajapakshe, the TID issued the summons to Dappula de Livera to record a statement over his earlier claims that  “There was a Grand Conspiracy with regard to the 2019 April Attacks.”

However, the former Attorney General did not report to the TID as summoned, while his lawyer submitted a seven-page objection letter on his behalf. (NewsWire)

The interim order preventing the arrest and recording of a statement from former Attorney General (AG) Dappula de Livera over a comment related to the 2019 Easter attacks has been further extended until June 22, 2023.

The interim order was extended today after the petition filed by the former Attorney General was taken up for consideration at the Court of Appeal.

In his petition, the former AG claims that the Terrorism Investigation Division (TID) had issued a summons to record a statement with regard to a comment made related to the Easter Sunday attacks.

Stating that the Police are not vested with powers to question his activities during his tenure as the Attorney General, Dappula de Livera said that it is a violation of the privileges given to an AG.

The former AG had, therefore, requested the court to issue an interim order preventing the summoning and his arrest over the matter.

Meanwhile, the Additional Solicitor General informed the court that a period of one month is required to obtain statements from the respondents of the case.

As the petitioner had not objected to the request, the Court fixed the case for hearing on June 22, 2023.

The Court of Appeal today issued an interim order preventing the summoning of former Attorney General Dappula de Livera to the Terrorism Investigation Division (TID).

The Court also issued an order preventing the authorities from recording a statement from Dappula de Livera pertaining to activities during his tenure as Attorney General.

The interim order was issued after former Attorney General Dappula de Livera filed a petition before the Court of Appeal today over the TID summoning him to record a statement.

The TID issued summons to the former Attorney General on 19th and 21st April 2023 to record a statement he had made with regard to the 2019 Easter Sunday attacks, days before his retirement.

On the directives of Justice Minister Wijeyadasa Rajapakshe, the TID issued the summons to Dappula de Livera to record a statement over his earlier claims that  “There was a Grand Conspiracy with regard to the 2019 April Attacks.”

Meanwhile, the Colombo Magistrate’s Court today announced it will not issue an order related to the arrest of State Minister of Tourism Diana Gamage on the offences committed under the Immigration and Emigration Act.

Colombo Chief Magistrate Prasanna Alwis stated that the order will not be issued as the Criminal Investigations Department (CID) has powers under the law to arrest the State Minister.

The lawyers representing the petitioners, including civil activist Oshala Herath, had pointed out during an earlier hearing that even though sufficient evidence has been provided the CID had failed to apprehend the State Minister. 

Thereby, a request was made from the court to issue an order prompting the CID to arrest State Minister Diana Gamage for breaching the Immigration and Emigration Act.

Issuing the verdict on the matter today, the Court stated that the investigation officers are vested with powers under the law to arrest the State Minister with regard to the relevant offence and hence, it was not required for the court to issue a further order on the matter. 

The court’s decision comes after the writ petition filed against State Minister of Tourism Diana Gamage challenging her citizenship and right to hold a Parliamentary seat was taken up for consideration today. 

Also, the Court of Appeal today issued an interim order preventing the naming of Senior Deputy Inspector General of Police (DIG) Deshabandu Tennakoon as a suspect in the Galle Face protest incident.

The court order was issued preventing the implementation of the letter sent by the Attorney General (AG) to the Criminal Investigation Department (CID) asking to name Senior DIG Deshabandu Tennakoon as a suspect in the case pertaining to the attack on protesters at the ‘GotaGoGama’ protest site on 09th May 2022.

The case was taken up for hearing before the Appellate Court bench comprising the President of the Court of Appeal, Nissanka Bandula Karunaratne and Justice A. Marikkar. (NewsWire)

Former Attorney General Dappula de Livera who was summoned before the Terrorism Investigation Division (TID) today has reportedly not appeared before the TID as instructed. 

According to reports, a lawyer representing the former Attorney General had reported to the TID on his behalf.

The lawyer is said to have submitted a seven-page legal objection to the Terrorism Investigation Division.

Former Attorney General Dappula de Livera was issued a summons yesterday to appear before the TID to record a statement with regard to the 2019 Easter Sunday terror attacks.

The summons was issued after Minister of Justice Wijeyadasa Rajapakshe had instructed the incumbent Attorney General to record a statement from Dappula de Livera over a claim made with regard to the Easter Attacks days before his retirement.

Stating that Dappula de Livera had claimed, “There is a Grand Conspiracy with regard to the 2019 April Attacks”, the Justice Minister said there is a certain degree of scepticism surrounding the investigations due to his statement. 

Minister Rajapakshe further stated that Dappula de Livera has been summoned before the TID to determine based on what information the latter had made the remarks and why he had made such a statement.

Former Attorney General Dappula de Livera has been summoned to the Terrorism Investigation Division (TID) tomorrow (19).

Minister of Justice Wijeyadasa Rajapakshe revealed that the incumbent Attorney General was instructed to record a statement from Dappula de Livera over a claim made with regard to the 2019 Easter Attacks days before his retirement.

Stating that Dappula de Livera had claimed, “There is a Grand Conspiracy with regard to the 2019 April Attacks”, the Justice Minister said there is a certain degree of scepticism surrounding the investigations due to his statement. 

The Justice Minister pointed out that Dappula De Livera as the Attorney General at the time of the Easter attacks should have summoned the Police and ordered them to conduct further investigations if the level of inquiry was insufficient or could have made submissions at the Magistrate’s Courts in this regard.
