The Bar Association of Sri Lanka (BASL) has expressed grave concern over the death of a 29-year-old suspect while in the custody of the Homagama Police, calling for an immediate, impartial and transparent investigation into the circumstances surrounding his death.

In a statement, the BASL identified the deceased as Ishara Harshakumara, a father of two from Kiriwaththuduwa, who had been arrested in connection with a drug-related investigation.

The Association said family members who visited the Homagama Police Station on October 25 had reported observing physical injuries on the suspect, which they believed indicated that he had been severely assaulted.

However, the BASL noted that the Police Spokesman had provided a different account, stating that the suspect had developed a sudden illness during an operation and died following admission to hospital.

Highlighting these conflicting accounts, the Association stressed the need for a credible and independent investigation to establish the circumstances surrounding the death.

The BASL emphasised that the State has a fundamental responsibility to protect the lives, health and physical safety of individuals in police custody.

It further stated that any allegation of custodial violence or ill-treatment must be treated seriously and that those responsible, if wrongdoing is established, must be held accountable under the law.

The Association noted that the Homagama Magistrate’s Court had ordered a post-mortem examination and that a preliminary inquiry had commenced under the direction of the Homagama Assistant Superintendent of Police.

However, it called on the Inspector General of Police and relevant authorities to ensure that all evidence is properly preserved and examined, with investigations conducted without interference or prejudice.

The BASL also stated that it would consider further action if necessary and keep its members and the public informed of developments. (Newswire)
